Terms of Use

Object

These "Terms of Use" were drafted to provide the legal framework and conditions for all the services provided by the CNRS News website and its use by the "User."The Terms of Use must be accepted by every user wishing to access the website. They act as the contract between the website and the User. Access to the site by the User means that he/she accepts the Terms of Use hereby described.

Eventualities:

• In case of non-acceptance of the Terms of Use set forth in this contract, the User must forego all access to the services offered by the website.
• CNRS News reserves the right to unilaterally modify at any time the content of these Terms of Use.
 

Definitions: 

This clause is intended to define a number of key terms present in the contract:
• User: This term refers to any person using the website or any of the services offered by the website.
• User Content: This is the data transmitted by the User within the website.
• Member: A User becomes a member when he/she is logged into the website.
• Username and Password: Makes up the complete information needed to identify a user on the website. The username and password lets the User access services that are reserved for members of the website. The password is confidential.

Access to services:

The website grants free access to the following services:
• information content
• post comments
• customized navigation with personalized themes of interest
 monitoring new releases via RSS or Newsletters.The website is accessible for free from anywhere to any user who has access to the Internet. All costs incurred by the User to access the service (hardware, software, internet, etc.) are at his/her expense.

Circumstances:

The non-member User cannot access members-only services unless he/she identifies himself/herself with a login and password.

The website continually strives to ensure quality access to its services, but cannot be held liable if optimal quality is not achieved.

The website will not be held liable for any unforeseen or unavoidable event that results in an interruption or malfunction of the network or server.

Access to the website’s services may at any time be subject to interruption, suspension, change without prior notification for maintenance or for any other reason.

The User will not claim any compensation following the interruption, suspension or amendment of this contract.

The User can at any time contact the website through the various means described on the “Contact Us” page.
 

Intellectual Property:

The trademarks, logos, signs, and all other content present on the website are protected by the Code of intellectual property, particularly copyright.

The User shall obtain the website’s prior approval for any reproduction, publication, or any content duplication. The User agrees to use any content on the website in a strictly private setting. Use of content for commercial purposes is strictly prohibited. Any User-generated content is his/her sole responsibility. The User agrees not to upload content that may harm the interests of third parties. Any legal action initiated by a wronged third party against the website will be assumed by the User.

User-generated content can at any time and for any reason be removed or modified by the website. The User will receive no justification and notification prior to the deletion or modification of his/her content.
 

Personal Data and Privacy: 

Information collected during the website’s registration process is necessary and required to create the User account. This information, especially the User’s email address, is subject to data processing solely intended for the administration, management, and operation of the services.

No personal data collected on the Website is publicly available, or will be transferred to third parties. Under the French Data Protection Act of January 6, 1978 amended in 2004, the User has a right to access and rectify any information concerning his/her profile. The User shall exercise this right via:
• His personal profile information when logged in to the website;
• A contact form;

Liability and Force Majeure: 

The source of the information made available on the website is sound and of demonstrated scientific quality. However, the website reserves the right not to guarantee the reliability of its sources. The information presented on the website is offered on a purely informative basis.

The User alone bears full responsibility for the use of information and contents of this website.

The User agrees to keep his/her password secret and not to disclose it to third parties. Any disclosure of the password, whatever its form, is prohibited.The User is responsible for any risk associated with the use of his username and password. The website assumes no responsibility.Any service usage by the User that directly or indirectly results in damaging the website will make him/her liable for compensation.

The website does not provide any optimal guarantee in terms of security and confidentiality of any transmitted data. However, the site is committed to do everything in its power to better ensure the security and confidentiality of said data. The website cannot be held responsible in case of force majeure or unpredictable and insurmountable events caused by a third party.  
 

Hyperlinks:

Many outgoing hypertext links can be found on the website, yet the web pages linked to these URLS do not engage the responsibility of the website, as it has no control over them—especially when found in public spaces such as user comments.

The User will therefore not make the website liable with regard to any content relative to the outgoing hyperlinks.
 

Contract Changes: 

The website reserves the right to modify the terms stipulated in this contract at any time.
 

Duration: 

The duration of this contract is unlimited. The contract takes effect when the User first uses the service.
 

User publications:

The website allows members to post comments. In his/her posts, the member accepts to respect the rules of Netiquette and the rules of law. The site has a posteriori moderation on user-generated content and reserves the right to refuse publishing it online, without any justification to the member.

The member keeps all of his/her intellectual property rights. But by publishing content on the site, he/she yields to the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, disseminate and distribute this content, directly or through an authorized third party, worldwide, on any support (digital or physical), for the duration of the intellectual property.

The member gives the right to use the content on the Internet and on mobile telephone networks.The publisher agrees to include the member's name next to his/her content when used. 
 

THE TRANSMISSION OF ANY CONTENT LISTED BELOW IS STRICTILY PROHIBITED BY CNRS NEWS

The User agrees not transmit content that is: disguised advertising; false or erroneous; may constitute a violation of literary, artistic, trademark and industrial or other property rights of third parties, such as image rights and the right to respect for privacy; abusive, libelous, defamatory, racist, xenophobic, revisionist or that damages the honor or reputation of others. Contents transmitted by users must not: encourage discrimination, hatred of a person or group of persons because of their origin or because they belong or not to a specific ethnic group, nation, race or religion; threaten a person or group of persons; undermine public order, subject to civil or criminal prosecution, or of libelous nature; be unconstitutional, extremist or emanating from groups banned by law; incite offense, crime, suicide and acts of terrorism or seek to justify crimes, acts of terrorism, war crimes or crimes against humanity; be pornographic, indecent or detrimental to human dignity; grant third parties direct or indirect access to pirated software, software serial numbers, software that enables acts of piracy and intrusion into computer systems and telecommunications, and generally any method (software or other) that infringes the rights of others and the safety of persons and property; include viruses or any other application that would be likely to disrupt or damage software, hardware and computers of the website or its users; constitute chain letters.

The User agrees to respect the image and reputation of the website and not to engage in any declarations and / or any action that might cause prejudice to the website. In case of infringement to laws, morality, to the present terms of use or for any other reason that can be freely interpreted, the website reserves the right to close its spaces of expression (comments section, etc.) for a limited or permanent time or/and delete information and referrals to such information. The website reserves the discretionary possibility to publish or not publish your content on its areas reserved for user expression, alter, adapt or translate them into any language in all forms and on all media, to keep them online or delete them at any time without having to keep you informed.
